The competences of this commission are a) the Preservation of the interests of the public service and b) the Identification of possible conflicts of interest in the context of the participation of public agents in the creation of companies and the activities of existing companies. Three schemes are concerned. They allow public research staff to:
- To exercise a role of manager and/or partner in a future start-up or an existing company that valorises the results of public research or teaching (Articles L. 531-1 to 6 of the Research Code),
- To provide scientific assistance, i.e. long-term consultancy, to a company that develops public research results (Articles L. 531-8 to 9 of the Research Code)
- Being a member of the management bodies of a commercial company in order to promote the dissemination of public research results: Articles L531-12 et seq. of the Research Code (Articles L. 531-12 to 13 of the Research Code).
The deontology commission issues a preliminary and systematic opinion as well as recommendations on all new and renewal files relating to articles L.531-1 to 17 of the Research Code. On request, it monitors authorisation files in order to possibly cancel an authorisation if a conflict of interest situation should subsequently arise. On request, it issues an opinion on
- Creation or takeover of companies outside the law on innovation (Article 25 septies III of Law n°83-6341),
- Cumulation of activities: in the event of serious doubt or refusal of authorisation likely to be issued by the hierarchical authority,
- Temporary or definitive departure in the private sector,
- Request to return to the public sector.
The deontology referent is an expert on these issues and an invited member of the deontology commission of the valorisation. She is at your disposal for any further information.
